Data Retention

We reserve the right to retain anonymized, aggregated, or de-identified data derived from your information indefinitely. Upon account deletion, we will take commercially reasonable steps to remove your identifiable data from active systems within a reasonable time, but we make no guarantee regarding immediate deletion from backup or archival systems, which may be retained for up to seven (7) years.

We implement commercially reasonable administrative, technical, and physical safeguards designed to protect your information against unauthorized access, alteration, disclosure, or destruction. However, NO METHOD OF TRANSMISSION OVER THE INTERNET OR METHOD OF ELECTRONIC STORAGE IS 100% SECURE. WE CANNOT GUARANTEE THE ABSOLUTE SECURITY OF YOUR INFORMATION. YOU USE THE SERVICES AND PROVIDE YOUR INFORMATION AT YOUR OWN RISK. In the event of a data breach that requires notification under applicable law, we will notify affected users as required.

California Privacy Rights (CCPA / CPRA)

If you are a California resident, you have specific rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), including the right to know what personal information we collect, use, disclose, or sell; the right to delete personal information subject to certain exceptions; the right to correct inaccurate personal information; the right to opt out of the sale or sharing of personal information; the right to limit the use of sensitive personal information; and the right to non-discrimination for exercising your rights.

We do not sell personal information as defined under the CCPA. We may share information with service providers as permitted by law.

AI and Automated Processing

We make no warranties regarding the accuracy, completeness, or fitness for any particular purpose of AI-generated outputs. You are solely responsible for how you use, act upon, or rely on any AI-generated results. Star Moon Technology LLC disclaims all liability for decisions made based on automated processing outputs.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STAR MOON TECHNOLOGY LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH THIS POLICY, YOUR USE OF THE SERVICES, OR ANY UNAUTHORIZED ACCESS TO OR USE OF YOUR INFORMATION. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THIS POLICY SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

Indemnification

You agree to indemnify, defend, and hold harmless Star Moon Technology LLC and its members, officers, employees, agents, successors, and assigns from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your violation of this Policy, your use of the Services, your submission of inaccurate or misleading information, or your violation of any applicable law or third-party right.

Governing Law and Dispute Resolution

This Policy is governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to this Policy shall be resolved exclusively in the state or federal courts located in New Jersey, USA, and you hereby irrevocably consent to the personal jurisdiction and venue of such courts. YOU WAIVE ANY RIGHT TO A JURY TRIAL AND AGREE THAT ANY PROCEEDINGS SHALL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS OR REPRESENTATIVE ACTION.

Changes to This Policy

We reserve the right to update or modify this Policy at any time at our sole discretion. We will indicate the date of the most recent revision at the top of this document. For material changes, we will notify you by posting a prominent notice on our Services or by email to the address associated with your account.
